APC Comments on Liebert Competitor Lawsuit

American Power Conversion Corp. (APC, West Kingston, RI) announced that competitor Liebert Corp., a subsidiary of Emerson Electric Co. and Zonatherm Products Inc., filed a lawsuit on February 5, 2004, against APC and third parties in the Circuit Court of Cook County, IL, alleging willful violation of the Illinois Trade Secrets Act, tortuous interference with contract, tortuous interference with prospective economic advantage, civil conspiracy and conspiracy to breach fiduciary duties.

Liebert and Zonatherm are seeking compensatory and punitive damages and injunctive relief. American Power is currently reviewing the lawsuit, and any potential counter claims, and intends to vigorously defend against it.
